Funeral services have been schedule for Michael Levigne, the 6-year-old Commerce boy who was killed Sunday. Visitation will be held from 6-8 p.m. on Wednesday, June 10, at Ginn Funeral Home, located at 90 Church Street in Carnesville. The funeral service will be held at 2 p.m. on Thursday, June 11, in the chapel of the funeral home.

A memorial fund has been established to help with the funeral expenses. Donations to the Michael Levigne Memorial Fund may be taken to Community Bank & Trust in Commerce. Contributions may also be mailed to: Michael Levigne Memorial Fund, c/o Community Bank & Trust, P.O. Box 59, Commerce, Ga., 30529.

Police believe Robert L. Clark shot and killed his 6-year-old grandson Sunday in a fit of rage over a dropped watermelon. Michael Levigne, a kindergarten student at Commerce Primary School was killed by a gunshot wound to the chest in the Troy Street, Commerce, home of his grandparents. Police say Clark shot his wife, Linda Dale Clarke, 58, in the chest/stomach area before he himself was shot by police officers after he fired a weapon at them.

My heart goes out to the family, But why was the children left with them if previous 911 calls were made, why didnt dfacs do their job with home visits and follow up on the random 911 calls? makes no sense. a child had to die because a grown man had anger problems!!!! Goes to show that you can't even trust your own family to take care of you and keep you safe! It's a good thing the police killed this guy, but it would have been nice for him to go to prison because then the inmates could have torn him apart. People like this make me sick. where is the mother? if the dfacs have had dealings with the family in the past then it sounds like they dropped the ball on this one. why does it take someone getting hurt or killed to say okay its time to step in. This child didn't have to become a statistic. prayers to the family, i am so sorry.

This is a sad a very disturbing incident I feel for the
rest of the family members and I feel bad for the officers
that was involed in the shooting along with Fire and EMS
personnel who responded.. It seems there is alot of cruel
people in this world and they dont care for no one except
themselves!! If it was just over a watermelon being dropped
this guy needed to be behind bars before now!! I have seen
and know of a few people in this county who does not need
kids becasue they are bad parents and it seems like the
legal system ( DFACS ) takes up for alot of them and lets
the kids stay in a bad place!! My thoughts and prayers go
out to all involed in this and to the Commerce Community...

Yes. It's correct. And from what a family member told me, the grand father and grandmother were the one's actually arguing over a watermelon and the grandson got in the middle of it (defending the grandmother) and was shot. The man had serious, serious problems....

Yes you heard correct WATERMELON. I have known this family for many years and the whole family is all crazy. Why the department of family and children services was not called in before now is what I would like to know with the number of 911 calls over the year. Makes me wonder about them to tell you the truth. And I agree with the police chief this families dynamics is very dysfunctional. Not only has the father of the child been in and out of jail so has both of the childs uncles. I tell you this is a tragic case for the little children in this situation....and as one person said do unto others as they have do unto you and we are not to be judgemental but GOD also said treat my little ones as you would treat me. This is a very sad situation.

I don't think when the were writting and deciding the second amendment. Did they ever believe that someone who is supposed to be a parent and grandparent would do, something a horrible as shoot there on grandchild.maybe when they pass new laws they need to remember all the sick,twisted,mentally ill people in the world. What really disturbs me is that the lunatic anti-gun crowd will use a murder of a child to further a political agenda. The poor child was shot and killed by a man...a sick, deranged man. The gun did not fire on its own, nor did it make the man pull the trigger. The fault truly lied at the front door of DFACS, who seem to be more concerned with kids not being in school than kids being placed into home with abuse and criminal activity.

The second ammendment has nothing to do with the death of this child, but rather with the idocy of the owner of the gun!! When DFACS does not act, children die and I have a 10 yo nephew who was killed by his mother when DFACS in Elbert County WOULD NOT ACT!! In fact, Elbert has had 3 children less than 10 yo to die by their parents, I guess the second ammendment did this to the children as well?

Please stay on the fact that a child DIED! There could have very well have been abuse prior to the use of the gun. What matters now is the family left behind will need much prayer. That poor child is now in Heaven, knowing nothing but peace and blessings. Those left behind are the ones who will now suffer from not having that wonderful angel in their lives.

This simply goes to show just how badly people can treat one another, and just how easily any situation can get out of hand.

I knew this family well. I taught Michael in Pre-K. I am heart broken and devastated at the whole situation. I believe DFCS dropped the ball on this one. There were so many incidents going on at that home that should have warranted the release of those children into the states custody...but they didn't do that. All we can do is pray for the family and pray that justice comes for Mr Clark. I will truely miss Michael as I know everyone who knew him will too.....

I too knew this family and worked with the family. This family was no stranger to domestic/criminal issues. These poor children lived in conditions that included emotional abuse and neglect. As a mandated reporter I don't know how DFACS or anyone else for that matter ingnored this!! It was so plain to see. I know that DFACS is overworked and it is a very hard job, but this is not the first time I have known Jackson Co. DFACS to drop the ball. I believe a full state investigation should be made to the Jackson County DFACS to see what the problem may be. I will truly miss Michael. He was a sweet and innocent child. May God be with his brother, he needs so much to be surrounded by positive emotions and unconditional love. I will continue to pray for this family.

The Atlanta Journal Constitution had an article about this.
It states that Ginn Funeral Home in Carnesville, Ga (Franklin county)
will have the body of this angel and be in charge of arrangements.

I met this family many, many years ago. Mr. and Mrs. Clark were very loving and had so much love for their grandchildren. Boy oh boy, did he have us fooled! I would have never thought!!!! Just like he fooled me, he has fooled many others.
My heart aches for the little brother that witnessed this terrible tragedy. God brings us all through hell to get us to Heaven.

ya know. people can be very decieving when it comes to acting like they are so caring in front of others, but when they get behind closed doors they are abusive. i take it the grandparents were probally recieving some kind of government assistance to help raise these beautiful babies, and to the grandfather it was about that little amount of money, but really he couldn't have loved these babies at all to treat them the way he did. we will see how much of a man he really is when he hears those gray bars slam behind him and especially one day when he will have to awnser for what he did, he better dress light for that occassion.

As for as DFCS they are cleaning house they have a NEW Director and a New Case Manager Supervisor so they are getting there It is so sad that they didn't clean up at the office sooner and maybe little Michael would still be here!! It's great that Dfac is putting new workers in there, BUT it doesnt matter how overworked a person is, or how overloaded a government is they should get energy from the suffering the children are having to bear to get up and go strong for their sakes. I know that a few differnet funds was started for little Michael's funneral. But after all the expenses is taken care of who gets the left over of funds?? Does the family get it for who?? There is really nothing that any one can say to make any of this better for the family,or any one else.I heard this whole tragedy over my scanner,and I was crying,because I could not believe what I was hearing.I have to say that the police at the scene did everything they could,to end this situation before the little boy was killed.The grand mother told them,she did not think he would harm the little boys through 911 on the phone.Bless her heart,I am sure she believed that with all her heart.Little Michael is in heaven now,and he is now safe forever.As for his little brother,what a strong little boy he is having to be.I pray that God watches over him through this difficult time,as I know in my heart he will in deed,and that God surrounds this precious little boy with peace in his heart so that he does not feel like any of this is his fault.We as adults can sit here and throw blame around to whom ever we please,but is that going to bring back little Michael.I think we should all just pray that nothing like this ever happens again.What is important here right now, is that we now have a 5 year old little boy that will never be able to forget this for the rest of his life,and none of us know how his little heart is feeling.I am sure he is not thinking about defacs,or the laws about guns,he is only thinking about what happened that day,and that he saw his brother get shot by his own grandfather,that was suppose to love them and keep them safe.So please right now,lets just pray for him,and what is ahead for him in his life.Let's be grateful to the police officers who did the very best that they could do, to put an end to this horrible act of violence.Let's say a prayer for them as well,for I know that what they saw themselves will remain in their minds and hearts for a very long time.May God Be with us all,as we have to face the fact that this could have been our child or our grandchild.May Michael REST IN PEACE !!!!

Everyone keeps talking about dfacs and what they didn't do step back and think did u do all u could do? Did u report these behavioral patterns thes people had? I do agree we need to stop pointing fingers there is a victim who will suffer the rest of his life, he will remeber everyday what happened in that house. Just listened to the scanner archive of this and it has to be the saddest thing I've ever heard. Mrs. Clark was begging and pleading for him not to hurt the kids. She had already been shot in the stomach/chest area. The grief that was going on in those few minutes is heartbreaking to think about.

Let me answer the question that was asked, Where were the parents?... He was taken from their home due to abuse and placed into a home with deadly abuse..... There needs to be an investigation of the DFACS Department in Jackson County. Methods and procedures put into to place and if the are not follow to the T, you no long have a job. Were is the accountability in the government jobs, there is none that is why we are in the state we are today. Overworked, I hated to hear that word, anyone that has a job today is overworked due to the downsizing that has been taking place for years in most companies. Suck it up and put in a good days work.... As for women that continue to live in abusive relationship with their children, that is very distributing. What can we do as a community to help women realize that they don't have to live way? Children deserve more!!! Michael is safe in his fathers arms.....God Bless Him

Abusive men are extremely slick & most police officers buy their 'stories' & their excuses(For instance- "Officer, my wife is crazy; You can't believe her; See how emotional she's acting? I was just trying to protect her from herself, good officer; Nevermind the fact that I have at least 3 prior domestics on my easily accessible criminal record")...The officers end up buying it(or not buying it, it's that they just don't care)and leave, but not before giving the "crazy" woman a hard time, that is. Jackson Co. DFACS is either on the abuser's side as well, or they try their best, and often succeed, at taking the children away from not only the abusive man, but the victim, the mother too. It only takes one call from the victim to either one of these agencies to learn that they will do her & her children more harm than good. I'm not basing this on one situation I just happen to know of; I'm basing it on many...too many. Just ask around the community, read old archives & commments from this newspaper, etc. to see for yourself. Same old story...everyday! ~~God bless!~~

I have a 8 yr old grandson and 11 yr. old grandson. I got sick to my stomach after seeing the beautiful little boys picture. It has made me realize I and my husband should be foster parentns. We can give love and a stable life to children who need us. I wish I had had Michael and his brother in my home. So sad for the 5 year old brother. Did the grandfather die?

You can claim DFCS all you want, but they are not the problem in all causes where a child is placed in a home with grandparents. Case & point - parents fighting for custody- Mother found to be unfit - Father working and able to provide children with good home- But because the lawyers got into an arguement in the court room the Judge gave custody to grandmother - Point is if only one parent is found to be unfit custody goes to the remaining parent. Grandparents have no right. Children were with father and grandmother was providing daycare while father worked.-Did this paternal grandmother get a say NO - Judge placed children in home of maternal grandmother that has history of viloence and drugs. You want to knock DFCS go higher go to the judge. True DFCS has problems but they are no the source. When DFCS goes out to do an inspection they call well guess what anyone can do a quick clean and everything is picture perfect.
Problem lies with all concern- NO ONE IS ACCOUNTABLE or HELD ACCOUNTABLE FOR ANYTHING IN THIS COUNTRY.
People are blaming DFCS but how many of those people are willing to open their home as a foster parent????????

- To Anonymous #27: I don't know if the situation you're describing is a case of 2 parents, divorcing or already divorced, fighting for custody(in superior court), or a case where DFACS has removed children from their home & are now having their hearings in the juvenile court, but I'm pretty sure that in the first case above, the superior court judge does decide where the children are placed, and in a situation where DFACS has removed children from their home & go to juvenile court, it is not the judge there that makes decisions regarding where the children are placed, it is DFACS who decides for everyone where the children are placed.

So, I think that you must be talking about a case in superior court over a custody battle, is that right?

you know if your a foster parent you should be in it for the children not for the system. As long as those are out of harms way for only a little bit then something good has come from it! No the system isn't all good but I can speak as a foster parent my heart is in it for the kids not the system or any other reason!! I know that God has placed these kids in my home to raise them as I did my own kids when they were growing up and these kids have been loved unconidational no matter what the system or any case worker or any body says. Yes there are good foster parents tnd there are bad ones no one is perfect but I can say that when these children leave our home they have had a good, loving, Christian, family experience!! When God sends one child home or to family it only opens our home to serve more children with the same love and Chrisstain values that they didn't get when they were at home with there families. And for the ones who says I couldnt do it (be a foster parent)well it's hard to let these little ones go but it does open our homes to help another and that is why we do what we do. Does it hurt you better beleive it hurts bad but we have to move on to help more. God Bless our little children!!

I am the parent of a 13 in Oglethorpe county, which Judge Adamson of Jackson county gave custody his father, who has beaten him with a belt until he drew blood, hit, kicked and watched years of abuse against me. I faught for my children presented evidence the father was a danger to the child, however since I am the other parent my word or my video taped evidence of his drug use and violent behaviors are not good enough, my son has went to the school telling of the drug use in the home however DFaCS worker stated unless the father becomes so impaired that he can't care for the child they won't do anything. Doing drugs in front of a child is ok with them, beating a child with a belt until blood is drawn is ok with them, and OK with Judge Adamson, he saw the pictures from DFaCS of the injuries and still awards custody to him, me however, am just a loving parent who doesn't beat her kids, I have since adopted two children, which Judge Adamson placed in my custody. As for DFACS the will do nothing until the child is DEAD or near dead unless you are a fit parent then the will harass you over the littlest thing. CHILD PROTECTION LAWS ARE SO SCREWED UP THEY DON'T PROTECT THE CHILD FROM THE ONES THEY REALLY NEED PROTECTING. AN ANIMAL GETS MORE PROTECTION THAN A CHILD IN THIS STATE.
