The Jackson County Board of Commissioners wants to ban the firing of guns in residential areas and is working on an ordinance to stop the shooting.

The BOC reviewed the proposed ordinance Monday night and commissioner Tom Crow pointed out several issues, including prohibiting property owners of larger tracts from firing a gun just because their property is not zoned for agriculture.

“This is not only a subdivision, but any residential home in the county, whether that home is located on a half acre or 50 acres,” Crow said.

Crow said he “could go along” with an ordinance regarding firing a gun in subdivisions, but not from just any single-family dwelling.

The board asked county attorney Julius Hulsey to present other options, including acreage exemptions, at the BOC’s next meeting, set for 6 p.m. on Monday, June 20, at the courthouse.
Hulsey said the ordinance was created following complaints about guns being fired in residential areas. He added that it does not infringe upon people’s rights to “bear arms.”

“It’s not intended in any way to restrict lawful use of arms,” he said. “It defines residential development and prohibits the discharge of firearms in those residential development areas. …We have researched this. Of course, we walked a fine line to avoid in any way infringing on the rights of the public to bear arms.”

Does noone else have an issue with this statement????

Let us make it illegal to use firearms (in certain areas), but this is by no means an attempt to restrict lawful use of firearms, except where we want it to be illegal to use firearms?

What kind of twisted logic is this?

Anyone who thinks this isn't merely the first step to make it illegal to shoot firearms EVERYWHERE has their head in the sand.

We don't need MORE LAWS restricting what we can do on our own property! What we need is more COMMON SENSE (uncommon sense?) and for the officers of the law to be allowed and encouraged to enforce the laws that are ALREADY ON THE BOOKS!!!

You may have a law degree but if I own a gun and can not go in my back yard and use common sense and safety and shoot said gun THEN THAT DOES INFRINGE ON MY RIGHTS TO HAVE A GUN.... Thats like having a hamburger and not allowed to eat it... Why can't I find county attorney Julius Hulsey in the J co govt web site? I'm guessing Julius Hulsey has a personal problem with someone near him and his answer is to make a new law to satisfy his personal problem but sacrifice the freedom of everyone else in the county.

All that is needed is a safety zone regulation similar to Michigan.
"Careless discharge: is associated with the exceptions.
Michigan: "Safety zones are all areas within 150 yards (450 feet) of an occupied building, house, cabin, or any barn or other building used in a farm operation. No person, including archery and crossbow hunters, may hunt or discharge a firearm, crossbow or bow in a safety zone, or shoot at any wild animal or wild bird within a safety zone, without the written permission of the owner or occupant of such safety zone. The safety zone applies to hunting only. It does not apply to indoor or outdoor shooting ranges, target shooting, law enforcement activities or the discharge of firearms, crossbows or bows for any non-hunting purpose."

This whole issue is on Hunter B and Bruce Y and the spoiled rotten crowd over in West Jackson.
Jim- We don't live in Michigan or anywhere else. The issue is a paint brush ordinance county wide not in sub -divisions and incorporated areas. I moved to unincorporated Jackson so I would not have to worry about ordinances and over restrictive policing by Nazi code enforcement.
If Mr.Hardy votes for this he and the family can forget my business, hair cut at Mr. Smiths ? Never again.
Fishing at Crows lake ? Over my dead body !

You see this is more then just guns . It's a group of men who are now doing buisness behind closed doors to pacify the chairmans neighbors. Nothing more and nothing less.

I wholeheartedly agree with Jim, EXCEPT, I would lengthen that law to target shooting in a residential area! Common sense does not always prevail, so perhaps a safety zone would. That would be all I would condone.

The Jackson County Board of Commissioners and their erstwhile attorney Julius Hulsey would be well-advised to extensively educate themselves about the current mood of infringement on the 2nd Amendment. What is really at stake is life control by anti-s trying to place restrictions on a God-given right to self-preservation and self-defense regardless of what tyrannical form politicians or anyone else gives it. A person discharging a firearm in one of these zones in self-defense is in violation? Don't laugh - - - this country is rife with ludicrous police action re 2nd Amendment violations and look at the zero-tolerance polices of the public school for evidence of stupidity unlimited. There are obviously current laws governing well-defined municipalities and discharges within certain densities, but unless very specific and tightly drawn they will be challenged by citizens and by the National Rifle Association if warrented. IS THIS A PROBLEM? PRESENT THE EVIDENCE ! How many and who have complained? This had better be 100% transparent, and not in keeping with the current class of politicians we are saddled with. People are fed up ! ! !

Individuals need to attend tonight's 6 p.m. meeting in Jury Assembley Room in the Jackson County Courthouse, 5000 Jackson Parkway in Jefferson (Maysville Rd.) and ask the commissioners the hard questions. Namely, who says this is problem (in Jackson Co. of all places - this ain't D.C., Chicago, L.A., San Francisco, Atlanta)? Who is trying to dictate to the vast majority what is legal or illegal (according to their interpretation)?

The Jackson taxpayer and voter expects his money to be spent on more important things, and, most importantly, wants the Government to stay out of his life and his pocketbook.

I am a gun owner and because of people that violate other people's entitlement to enjoy their small piece of property in peace and quiet in subdivisions/safety issues/concerns, this law needs to be implemented state wide! There is a law called Breach of Peace and Nuisance which many gun owners break. It is NOT about gun ownership. You can take your firearms to a safe area and target practice. I own a firearm. This law in NO way impinges on GUN ownership.

This ordinance would not be needed if the Jackson County Sheriff's Department knew of and enforced existing state law prohibiting discharge of firearms within 50 yards of any public road or street. Because of their ignorance our subdivision had to put up with dangerous shooting by a local moron. Our problem was solved only because he moved away - no sign of education of the Sheriff's Dept. Maybe he next Sheriff will bring about more competence and professionalism.

Because of other people's ignorance everyone has to pay .It's not JCSO job to babysit.They cant't be everywhere in this county. They have a job to do. Yes to serve an protect but not listen to a lot of whinning when people with any sense should know what the law is.So when someone trys to break in your home or you have to call a deputy for some reason think about their ignorance an hang up that phone. Thanks JCSO for putting your life at risk everyday for your county. YOU are doing a great job.

I do not want my 2nd amendment rights infringed upon either. But I also know something needs to be done about the 50 yard law and 22 rifles. We live in a residential neighborhood and 18 yr old with 4 other teenagers shot and it richoched off their neighbors house. Let's see 22 rifle bullets travel one mile and law says 50 yards nonsense. I have two young children and im scared for them to play outside.
